Well, well. Apple’s won its copyright infringement claim against would-be Mac cloner Psystar in California. Anyone surprised? As we’ve been saying all along, the key argument wasn’t the OS X EULA or Psystar’s failed monopoly claims, but pure, simple copyright infringement, since Psystar was illegally copying, modifying, and distributing Apple’s [...]

Well, well. Apple’s won its copyright infringement claim against would-be Mac cloner Psystar in California. Anyone surprised? As we’ve been saying all along, the key argument wasn’t the OS X EULA or Psystar’s failed monopoly claims, but pure, simple copyright infringement, since Psystar was illegally copying, modifying, and distributing Apple’s code. Psystar was also dinged for circumventing Apple’s kernel encryption in violation of the Digital Millenium Copyright Act, but that’s just another nail in the coffin, really. There’s still some legal fireworks to come, as Apple’s various other claims like breach of contract, trademark infringement, and unfair competition weren’t addressed in this ruling, but those are all secondary issues now — and we’d expect this decision to have quite an impact on the other case currently ongoing in Florida. We’ve broken down the highlights after the break, hit up the read link for the PDF and follow along.

And more…

Point Inside: Fact: stepping foot in a suburban mall can drain your vitality in a matter of seconds. And though I don’t think a deep disdain for the concept of indoor shopping complexes and what they’ve done to the very fabric of the American town was the driving inspiration behind Point Inside, they’re definitely onto something: With hundreds of mall maps that look a lot like those big directory signs, this app gets you in and out of your local mall as quickly as possible, all for free. Could use a few hundred more maps—some of my old tweenage haunts weren’t there—but if yours is listed, PI is great.

Agile Messenger: I’ve always been a little leery of Agile Messenger, since it’s usually priced at around $10, up there with the likes of Beejive, and it’s a little ugly—though the multi-account and push features are more than adequate. For a few weeks, though, it’s just two dollars. And they’ve just added a new feature called “Walk and Type,” which overlays your text over a live camera view, so you never have to take your eyes off you AIM conversations as you walk down the street. In theory. In practice, you will still die. Ranked for feature-bloat audacity, and shitty late night joke/newspaper cartoon potential.

Full Browser: As with every alternative browser in the App Store, Full Browser isn’t really its own browser, since it’s still using Mobile Safari’s WebKit renderer. That said, FB’s added features are worthwhile: the tabbing system, which is more traditional and desktop-like than Safari’s, makes up for its rough looks with efficiency, in-app email makes life ever-so-slightly faster if you spend most of your time browsing, the favorite sites speed dial is a mite faster than using Safari’s favorites, and inline text search is just, well, useful. A dollar.

WhatsApp: First, let’s try this: WhatsApp is like BlackBerry Messenger for the iPhone. Cool, right? If that doesn’t mean anything to you, it’s like an instant messaging app, tied to your number—not a screen name or PIN or anything—that integrates with your contacts. If you have the app, your friend has the app, and you’re both in each others’ phonebooks, you’re ready to go. Push notifications make this even more like BBM, in that you don’t have to keep the app open. Free for now, so GO GO GO.

PicTranslator: Translates text from photos, from whatever language you want. I love it because it fits nicely with my vision of what smartphones should be doing for us in the next few years, and it seems to work pretty well most of the time. I don’t love it because results are much, much better on the 3GS—you’re basically limited to signage with the 3G and 2G, because they can’t focus on small text—and because your $2 only gets you one language. Still though, extremely neat stuff, as long as you’re aware of the limitations. And now you are, so!

PocketBlu/FoxPop: From Universal and Fox, respectively, these are the new Blu-ray companion apps. PocketBlu, available now but not really compatible with much yet, is like an enhanced remote control for compatible titles, making navigating various BD Live features a bit more intuitive. It’ll also stream bonus content to your handset over Wi-Fi, which is pretty cool. FoxPop, which isn’t quite out yet, does things a little differently: It’s like a Popup Video feed that plays back trivia, photos, video, and other content to supplement the film. Bonus cool feature: it figures out where you are in the DVD or Blu-ray by listening to the soundtrack, and matching it to a timeline. Both should be coming soon to select releases.

Navigon Traffic: $90 for a navigation app is feeling more and more expensive by the day, and $20 for the new traffic function doesn’t feel like a steal either. That said, there are no monthly fees after that initial charge, the traffic data is crowdsourced and rich, and Navigon is one of the best nav options out there. Worth your consideration, if not your dollars.

Priceline Negotiator: Priceline’s main gimmick/selling point has always been its instant bid feature, and it’s well-suited to the iPhone. Give it a location, make your hotel room bid, and you know if you’ve got it or not pretty much that second.

ARGH: I somehow missed this one in yesterday’s augmented reality app roundup, so here goes. ARGH cheesily superimposes ghosts over your 3GS’s camera view, as if there were actually there. Upon seeing ARGH, most of your friends will groan and tell you you’ve wasted your money. But! Your senile grandmother will be legitimately spooked, your pet dog will be mildly confused, and your little cousin will probably chuckle a little. Two dollars.

iVIP: This thing is basically I Am Rich, except it offers (some?) services, in the form of memberships to various clubs and societies. It sounds a bit like a scam (A Cineworld membership? Really?) and the concept is inherently deplorable, but in separating a special, horrible kind of rich person from their dollars, iVIP is doing the world a service. $1000, or $450 for the “Blue” version, which is blue.

This probably won’t affect your day to day life (yet), but it’s an interesting development nonetheless. iTunes now allows you to window shop through your web browser.
Called iTunes Preview, you can now access any iTunes music page through your browser by selecting “Copy Link” and pasting it Firefox, Safari, IE, whatever you use.

At the moment, Apple isn’t doing very much with iTunes Preview. Sure, you can view music (videos and other media not yet online), but to buy or preview anything, you’re redirected into iTunes software. In that way, iTunes Preview really lives up (or down) to its humble name—it’s a non-interactive preview of iTunes content for people who haven’t loaded the software (as well as bloggers who’d just like to link a webpage rather than an app). But is it so crazy to imagine a day when Apple allows us to buy music free from the confines of their software?

Yes, yes it is.

While every Apple Store is in some sense a place of reverence, the new Upper West Side store unabashedly evokes that feeling. It also used to be a Victoria’s Secret and took longer to build than the empire state building*.

I call it the temple because it goes beyond even previous stores in conveying that its a [...]

The top floor’s a vast open space, enclosed by spartan stone walls which support a massive glass ceiling. The rows of tables in the main room feel like pews. I can’t tell you—and the pictures can’t show you—how utterly open and expansive the room feels. Apple says it has more demo units than any other store in the world. To give you an idea of the space, the walls are 45 feet tall, and could fit 11 Apple 5th Avenue Cube buildings inside. The spareness is breathtaking. It’s cold. Not literally, but the stone walls, the glass, the sheer space rob it of any sense of warmth or feeling. The only sense of life in room is the products. It’s a temple to them, really.

The beating heart, where things actually happen is tucked underground. The Genius Bar and personal training space is the biggest ever in an Apple store, able to handle up to 100 customers at once at 45 feet long. It’s pretty much like any other Apple store down there, just bigger.

It’s impressive. The store, at 67th and Broadway, opens Saturday. And they’re giving away 2500 commemorative shirts if you’re that kind of crazy.

Then, he declared his enraptured love for all things Apple:

[In my home we are] all Apple. Apple uses the best technology for their [computers]. Apple says to their customers: if you buy a computer from us you can be sure we have selected the best technology inside for you. That is their promise to consumers. Their promise to consumers isn’t we’ve selected the best technology for you with the exception of what Intel allows us to use. That’s not their promise. And that’s why Apple uses the best technology where they want whenever they want. And that’s why I’m all Apple! At home it’s just Macs everywhere. It’s Nvidia’s technology in all of them but I use Macs. My son has two Macs, my daughter has a Mac, there’s an extra Mac just in case and my wife has a Mac. It’s just Mac, Mac, Mac! Because I know it’s got the best stuff inside.

That’s quite an enthusiastic endorsement. So enthusiastic that he crosses the ultra-fanboy territory and gets into the “I’ve my hockey knee pads here and I’m ready to perform iphonelingus on you if you pick me as your tablet provider, Apple” danger zone.

World’s first iPhone virus has been reported, which is creating some buzz in at least Australia right now, however, it is said that world over iPhones that are jailbroken are under threat.

The virus, dubbed the ikee worm, breaks into iPhones, changing their lock screen wallpaper to an image of 1980s pop star Rick Astley with the message: “ikee is never going to give you up”

It was found that virus can only infect users who have “jailbroken” their iPhones in order to allow them to run applications that have not been approved by Apple or those who are illegitimately running iPhone with non-exclusive operators.

The “ikee” worm, as it’s being called, takes advantage of the fact that jailbroken iPhones with SSH installed all have the same default root password of “alpine,” and once in the system it changes your wallpaper to an image of Rick Astley and then tries to install itself on other jailbroken iPhones on the network.

IT security and data protection company, Sophos, hasn’t confirmed any infections outside of (Australia), and to be clear, this worm can’t get to stock iPhones or jailbreak owners who haven’t installed SSH – but if you’re running a hacked phone we’d say you should change that root password just to be safe right away.

So if you have installed SSH, here’s how, to change the password

Type: ssh root@(iPhone IP address)

When prompted for the password type: alpine

Now you’re connected the phone…

type: passwd

It should then prompt your for a new password – type one that you’ll remember. There’s no easy way to reset it if you forget it.
